These Terms of Service ("Terms") govern your use of Physical Data Recovery's services operated by Creative IT (UK) Ltd ("we", "us", or "our"). By engaging our services, you agree to these Terms.

1. Service Agreement

Scope of Services

We provide professional data recovery services for storage media including hard drives, SSDs, RAID arrays, and other digital storage devices. Services include evaluation, recovery attempt, and data return if successful.

No Guarantee of Recovery

While we employ industry-best practices, we cannot guarantee successful data recovery due to the nature of media failures. Our "no data, no fee" policy means you only pay for successful recoveries.

Important: Media Risks

Data recovery attempts may result in complete loss of data. By proceeding, you acknowledge this risk and that we cannot be held liable for any pre-existing damage to your media.

2. Client Responsibilities

Accurate Information

You must provide accurate information about the device, failure circumstances, and data importance. Misrepresentation may affect recovery success and void our no-fee guarantee.

Legal Ownership

You warrant that you are the legal owner of all media submitted or have authorization from the owner. We reserve the right to request proof of ownership.

Prohibited Content

We may refuse service for media containing illegal content. UK law requires us to report discovered child exploitation material to authorities.

3. Fees and Payment

Evaluation

Initial evaluation is free for standard recoveries. Complex cases (e.g., severe physical damage) may require a non-refundable evaluation fee, applied to recovery costs if proceeding.

Pricing

Recovery fees are based on device type, damage extent, and required labor. We provide written estimates before work begins. Prices may change if initial assessment proves inaccurate.

Payment Terms

Full payment is due before data release. We accept major credit cards and bank transfers. Late payments incur 1.5% monthly interest.

4. Data Handling

Confidentiality

All client data is handled under strict confidentiality per our Privacy Policy. Employees sign non-disclosure agreements and access is role-limited.

Data Return

Recovered data is returned on new media unless otherwise agreed. Original media is returned unless disposal is authorized. We securely wipe our systems after 30 days unless retention is requested.

Backup Recommendation

We strongly recommend maintaining backups of recovered data. We are not responsible for data loss after return.

5. Limitations of Liability

Maximum Liability

Our maximum liability for any claim is limited to the fees paid for the specific service. We are not liable for consequential, indirect, or special damages.

Media Damage

While we exercise extreme care, we are not liable for media damage occurring during recovery attempts when standard procedures are followed.

Important Limitation

We are not responsible for: (a) data loss prior to receiving your media; (b) failures due to prior DIY recovery attempts; (c) media with counterfeit components.

6. General Terms

Governing Law

These Terms are governed by English law. Any disputes shall be resolved in London courts.

Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified via email or website notice.
